The requirements set out in the Queensland Government Better Regulation Policy aim to improve the quality of regulation through a robust, transparent and evidence-based process.
The policy sets out:
- The regulatory review requirements – the Regulatory Impact Analysis (RIA) process that must be undertaken for all new and amending regulation
- Preparing an Impact Analysis Statement (IAS) – the requirements and guidance for preparing an IAS.
There are 5 key steps to the development of an IAS:
- An agency must notify the OBPR when a regulatory solution has first been identified as a viable option to address a policy issue.
- Notification to the OBPR should be made using the Notification of regulatory proposal template.
- An Impact Analysis Statement (IAS) is required for all regulatory proposals.
- Agencies are to prepare an IAS using the IAS Template: Impact Analysis Statement
- An IAS must be approved and signed by the Minister and Director-General.
- Proposals with significant impacts require a Full IAS consisting of a Consultation IAS and a Decision IAS.
- All IASs must be published when the government decision or regulation is publicly released. A copy of the IAS must also be sent to the OBPR for publication.
